Mediation - What Is It?

Mediation is a process in which an impartial outsider, a mediator, works with parties to a dispute or disagreement, seeking a solution they can all agree to.

Benefits of Mediation

  • Mediation provides an opportunity for the participants to maintain control in fashioning a solution rather than surrender the matter to a decision maker like a judge or a jury who will decide the outcome.
  • Mediation provides a neutral setting to discuss all aspects of a dispute in order to understand the views of both parties involved.
  • Each party can identify facts and opinions he or she believes is important in order to come to an agreement.
  • The mediator is a neutral party who keeps conversations under control.
  • The mediator is trained to walk parties through difficult negotiations.
  • The mediator will not take sides. Mediation takes place at a safe place to allow parties to listen to all points to consider without feeling environmental pressures.
  • Mediation will attempt to clear up misunderstandings, ask questions and find answers.
  • Mediation allows each party to be heard – perhaps for the first time. No agreement is made unless both parties consent to it.
  • Mediation is less time consuming than going to court.
  • Mediation doesn’t have to be resolved in one mediation session. Additional sessions may be scheduled to complete details, ask additional questions, and come to final agreements. It is not over until you say it is over.
  • Parties will have a clearer understanding on options they have, even if an agreement is not made.
  • Mediation may be less expensive, particularly if you do not have to go to court.
  • Mediation may be less stressful than the courtroom.
  • Mediation may allow part of the dispute to be settled which will save time in court later.
  • Mediation is private and confidential.
  • Mediation has a high success rate.
